80% Receivers and Blocks of Steel Now Firearms in PA

I just got my info packet from PSPS. 80% receivers and frames are now to be treated like firearms in PA. As can be read in the linked article, pure BS as any item can meet the definition of "partially manufactured".

I don't think the danger is as imminent as VA, but the re-districting push certainly has us heading in that direction.

without a definition, how can it be enforced? it only applies to retail suppliers, anyway so it is not within the scope of your burgeoning empire.

The ar15 type rifle uses a upper and a lower receiver so the definition is really off.

There was a case not long ago about the definition being incorrect and a man being acquitted for just this reason law was too vague.

This may set a precedent somehow in this Pennsylvania bill.

I beg to differ Justa. They sent me a form that is a make-shift substitute of the PA Handgun form that is to be used for the transfer of 80% receivers and frames. As NFADLR points out, the definition of what constitutes "incomplete manufacture" is not definable.

From the PA Sate Police Website....

Partially-Manufactured Frames, Receivers and Kits
As of December 16, 2019, the sale of partially-manufactured frames, receivers and kits which include the same, requires a background check through the Pennsylvania Instant Check System, in accordance with the Attorney General’s binding opinion and applicable requirements within the UFA. No sales may occur by a licensed firearms dealer without such a check.
As of January 9, 2020, the PICS background checks for the partially-manufactured frames, receivers and kits will be able to be processed. Directions on how to conduct a check for a partially-manufactured frame, receiver or kit can be found in this Letter to Licensed Firearms Dealers. All transactions will require a completed Application for Purchase (Partially-Manufactured Frame or Receiver for a Pistol or Rifle), Form SP 4-121.


So the question I ask is....Is it now illegal to purchase such an item from a non-licensee in PA? Is it illegal to sell by a non-licensee in PA? I can tell you that as a licensee, I would not even bother with 80% stuff.

There is no mention on any of the 80% sites that I could find.

In my opinion, this is standing on less than shaky ground. Any court challenge will torpedo it in short order.

I am amazed though, that the State Police jumped into action and had forms developed and in the mail to all licensed dealers in relatively short order.

What constitutes a parts kit? Demilled parts kits are not firearms. Building a FAL or an AR is still legal in Pa.

Dealers generally do not own parts kits, only the public at large.
Dealers sell 100% receivers.

The purchase of spare gun parts over the internet, such as barrels, mags, sights, scopes, stocks, bolts, 100% receivers is still legal. Building 100% guns is still legal in Pa.

Purchasing 80% receivers is still legal, even in NYS today, and they do not go thru FFL's.

I do not read a prohibition to the public to stop buying gun parts either.
Already existing 100% ghost guns have been legal in Pa, and must still be legal, as they are not banned.
