The Empire Strikes Back

The Empire State has been enforcing "the gun show loophole," and arresting individuals in stings, same as the BATFE.

http://www.ag.ny.gov/press-release/a...-investigation

Apparently, undercover State Police made arrangements to buy firearms from individuals they met at smaller NYS gunshows, and to do so "off premises."

They also told the sellers that they "probably would not pass," a NICS check.

What's more the Gunshow Promotor, is ALSO responsible for ANY person sellng a gun and failing to get a NICS check on the buyer, even when the undercover state police arrange to buy it at the guys home.

It IS legal for an individual, to sell guns without an FFL, at a gunshow, as long as a NICS check is conducted by the show operator.
The BATFE frown on this practice of non FFL holders selling, even IF NICS checks are conducted.

Apparently, the whole city/area for a radius of 50 miles from the gunshow epicenter, comes under the gunshow regulation that day; i.e. you cannot sell a gun FtF anywhere in the locale, during the gunshow; or immediately before or after, but the exact time frame has not been determined. Apparently gunshows spur FtF gun sales,by the general population.

The problem is that there is no legal requirement for FtF transaction to get a NICS check,------EXCEPT, DURING, OR AT, A NYS GUNSHOW.

The NEACA President is under investigation, for those shows are under his promotion, and responsibility, if any guns are sold FtF in the general geographic area, during the gunshow, & before and after.
--------

In another case, the State Police raided a gunstore and arrested the owner for warning that pin removal on a fixed stock NY compliant AR15 clone was illegal and showing how it could be done, but not to do it after a "customer" asked.
The cops also allegedly pounded the stocks on the counter to show how flimsy Colt and Bushmasters method of stock pinning is. The owner was arrested for selling assault weapons.

According to the link below there is a settlement pending.

It is still legal to buy a firearm from a dealer and go through a NICS check.
They have not figured out how to stop those sales yet.
Boomburg is likely working on THAT!!

Similar law in Colorado. How is someone supposed to know there's a gunshow in a city 40 miles away? It's not theirs, or my, responsibility to exchange info. I can see a lot of trouble caused by something like this.. especially for those who don't go to gunshows on account of the hassle and they arent much fun anymore!

Clearly a first rate AG's office. I don't even think about half of these guns even exist.
The gun types included:

3 AR-15 (Assault Rifles) (don't think there is any such thing as an assault rifle definition at least in federal law anymore)
1 semi-automatic rifle called a "Mauser" (from Czech Republic) (wtf?)
1 Savage 7mm Rifle
1 Remington Model 710
1 Colt 7.72 x39 (7.72!)
1 Enfield Military rifle (pattern 1853?)
1 Browning .22 cal, model 235 (model 235?!)
1 Ithaca .22 gauge (Gauge?!)
1 Remington 25.06

If someone says --I cant Pass a Nics check at a gun show --You can bet they are a sting operation... We always go to the parking lot and down the road and make the deal-No money changes hands on GS property..

I know one guy who was busted -sold an AR 15 he bought from his FFL dad -he got busted By blooming idiotburgs guys at Rochester GS,, he sold the gun and a month later they came after him ---

Exactly. This just seems to be common sense to me.
