C&R FFL in Mass.
Does anyone know if there are any extra limitations for a Mass. C&R FFL holder that don't apply to the rest of the free world? (California not included of course).

Since you do not have an state dealers license, the state considers you a private buyer. Log the C&R into your bound book, then file an FA10 with the state as a registration, not a transfer. Also, don't forget that the PRofMA won't let you sell more than 4 firearms in a year without going through an 01 FFL. That's for in state sales where an FA10 is used, of course.
You can get more information on the MA firearms list http://www.goal.org/maf.html There are several MA C&R holders that are regular posters there. I'm not sure yet how the AG's "Consumer Protection" regs will affect C&R pistol purchases. You will also find that some C&R dealers just will not send handguns to MA, even if it is legal, rather than deal with the mess we have. I don't like it, but I can't really blame them.

I'm a MA 03. You have to register each gun via a F10 form.
There's a specific clause in the MA gun laws that exempts curio and relics from things like the Attorney General's consumer protection crap that keeps many 01 pistols out of the state. Get an 03 and have fun!! |

The attorney general's regulations and "The List" only apply to "Handgun Purveyors" in the state of MA, i.e. gun dealers. Under the attorney general's definition of handgun purveyors is a list of those exempted. While it doesn't call out C&R holders directly, it refers to the US law governing and defining C&R dealers. In other words, since C&R holders aren't handgun purveyors, the regulations and list don't apply. However, the federal laws do and the MA laws governing storage, registering, etc apply. Thanks for the clarification. And to think, I was about to pay a lot of extra money to try to get one of those Colt Sistemas into the state before "The List" came out. lol... I'll just put in for my C&R and wait it out then. Thanks again! |
