26 States do not have to participate in the mandate to expand Medicaid rolls for the poor--that includes New Jersey, Florida, etc.
That list of States will expand, as the feds cannot penalize the states for not cooperating. Obama is screwed.

The individual mandate, however, stands as a tax.

That means the poor who cannot be covered in the 26 states expanded Medicaid rolls, will be taxed $2000 ea. They cannot pay and cannot buy ins.

Also anyone with means has to either buy ins or pay the $2000 tax. The Tax will rise to $6500 each; that is legal. That is if Congress does not repeal the tax.

The whole nut is that if the medicaid expansion of Obamacare is dead, the whole bill is dead, especially when the tax will be repealed.

The icing on the cake is that the tax is legal, and that tax will be repealed like an ice cream cone, melting in the 120 Phoenix sunshine.

Roberts sold us out like nobody's business.

I wonder how much money he got to switch sides like that...

Roberts was right. He was brilliant.

The bill is dead on arrival because he took out the mandate that states had to expand their medicaid rolls to cover illegals, space aliens, commies, black panthers, and everyone else in between.

26 States definitely will not expand their rolls. and I'd say another dozen or so INCLUDING ARIZONA, or maybe all the rest of them will join in.

Afterall, most states are bankrupt and the Feds will not pay and cannot penalize the states, by withholding highway funds or any other funds for not playing ball with Obamacare.

Obamacare is a gutted shell, for working middle class Americans, who already have health ins.

Obama has a pyhhric victory; he just gave white people a bonus and screwed the poor.

Obama promised the Russians he would have much more "flexibility" after the elections.
Who thinks a Romney or Republican vote is a waste of time or pissing in the wind now?
The Courts have said Obama care is the the legal will of the people, the coming election will give truth or the lie to that proposition.

We'll have to see just how this will play out.

ObamaCare is legal, as a tax! So, Barry was wrong all those times he claimed it wasn't a tax. This also slaps Congress on the wrist as it deliberately says that Congress' powers are limited. They cannot make you do certain things, unless they call it a tax.

States do not have to participate, and the Feds can't make them. Not just the 26 that brought suit, but ALL of the states can 'opt out'. There is no benefit to the states to opt in, and given the cost, a huge reason to opt out.

Barry also claimed that the penalty (tax) would go to the insurance companies and states. We now see that it was a lie. The tax goes to the Feds, just like many people figured it would.

So, Obama may have won the court case, but the PR battle will be a nightmare if the Republicans bother to use it.

The lesson is to give up any faith in men or earthly leaders. We can bitch about the SCOTUS, congress, and Obama, but it's the shithead next door who voted these clowns into office and cheered when it was proposed and eventually passed. A constitutional republic is an anomoly in history, it'll pass.

There ain't shit that Willard can do about it now and I'm sure he'll pick more "Conservative" SCOTUS judges than his predecessors. The majority of "Conservative" justices sure did right by us, didn't they?

Welcome to New Zimbabwe where all problems can be solved if we just take everything from the undeserving working class and divide it among the "disadvantaged".

You have Robert Mugabe Jr and his quislings promise on that.

I pretty much agree with most of your posts on this issue. Only question I have is how did the white people get a bonus?

Only when they are perverted,,, as they have been by Obama.
Our Democracy has the seeds of it's own destruction,, if the majority so chose,,, or the majority can wise up,,, or not.
Health care as we know it was modified forever in 1965, re-modified in 2010, now it must be re-modified again as a economic stabilizer,,, symbolic votes are ineffectual as wrecking balls and won't do it,,,, in my opinion.

I'm considering taking my money and moving out of the USA. There are several other countries which won't tax me to death. I just need to find one that also allows me to hoard FALs.

Switzerland has potential. They have the lowest tax revenue as % of GDP and they encourage citizens to keep a Sig 550 at home in case of invasion. Quite a difference...

Plus, their currency is actually stable.

The poor and unemployed, will NOT be covered in any of the states that refuse to bankrupt themselves by expanding the medicaid roles.

The black poor will have to pay the tax--no exeptions allowed, yet-- their earned income credit will be hit by the tax-- unless congress passes a new law stopping that from happening--which it won't do.

The white middle class already has health ins and will not have to pay the tax.

It is loose-loose situation for Obama and he is too stupid to realize it until he reads my posts. His staff is also too god damned dumb to realize that they just got bombed out by Roberts.

It is because the choom gang looser, and CZARS, have had too many brain cells fried by "maui wowee."

This just turned the tide for Romney. It'll be interesting to see if he gets a bump in the poles from this. Roberts just carpet bombed Obama and the R's are calling him a traitor. Neo Cons are morons. This was the single greatest partisan act a supreme court justice has ever pulled and it was so smooth his own party is barking for his head. Genius.

You fail to see the beauty in this legal interpretation law. Yes, states can opt out. Let's say 26 states opt out and 24 opt in.

WHO is paying the federal taxes for this program (and that is not just the "tax" for not having insurance)? Why of course the citizens of ALL 50 states pay. And who benefits? Only the citizens of 24 states that opt in.

DUH!!!

There won't be a growing list of states that opt out when the bill is being paid even by those that opt out. Quite the opposite is going to happen.

It's obvious why you can only work for the government. The States that opt
out DON'T have to pay for the health care of every Tom Dick and Harry that
can't or won't buy healt insuarnce. The States that opt in WON'T get a dime
extra for the expanded Medicare rolls, get it?

Roberts correctly said taxation is in the Constitutional purview of Congress, what is done by the duly elected can be undone by the electorate was his opinion.
Apparently Roberts believes in our Democracy as set forth by our forefathers.

There are ALOT of "middle class" that don't have insurance. Mainly due to the fact that in this economy, many are "lower middle class" now. Insurance is one of the first things to go. Many people taking lower paying jobs are not getting the insurance benifit like they used to either.

Those unable to afford $1k plus a month for thier families insurance, but are not on welfare, will be the ones to pay the price. (this group is growing daily)

Shouldn't the role of the Justice be to interpret the Constitutionality of the Law based upon the Constitution and not play partisan politics? Isn't that "legislating from the bench" and "judicial activism"?

I would be happy if everyone just followed the Constitution....

I would be as well. But from my perspective what I wrote above is what happened. Didn't say it was good. There's a book called The Hologram of Liberty that's worth a read if you haven't already picked it up. The Justices having life terms and being appointed by a partisan elected official is what the Federalist wanted to have happen so things like "legislating from the bench" and "judicial activism" would have this kind of effect on creating a totalitarian central government. I do believe from what I've read of your posts you and I are peas in a pod.

You are SOOOOO wrong. This is going to be paid from the general fund, same as defense, National Parks and Veterans Affairs. If Texas opts out they will still be paying for Obamacare in the other states.

Good question. Here's the answer. Democraps, rino's, and other comunnists simply cannot be honest and upfront about their plans. The know they would be thrown out if they did. Therefor, they must lie, cheat, and decieve to get their way. They know the public will never go along with their ideas, so they use the court sytem. Just like yesterday.

It was the Republicans that used the court system, that took the law to court. They lost, much to their surprise. This is far from the end of the fight, Obama won a battle, not the war.

No. I cannot believe there is a person alive today that does not understand what democraps, rinos and other communists have planned. It's not whether or not they are upfront about their plans, or whether or not people are deceived. To the extent that any people remain in the dark about what what the new aristocracy has planned, it's because they want to be.

The question on the table isn't what they are going to do, it's what we are going to do to head it off. And the answer isn't vote for more republicans, that's what got us here.

as a member of a federally recognized indian tribe i believe i am exempt from the "individual mandate" and do not have to buy health insurance, i feel special. unfortunately, the indian health service does a very good job of ending the suffering of indians and providing shitty service, which is why i currently have private health insurance, but i still "feel" special. i think the irs enforces the "tax", tony soprano would be proud of dis scam

Alant, there's not one shred of this law that is constitutional, and even you know it. Please tell me, if this pos is such a good deal, how is it that it snaked it's way all the way through the house, senate, and scotus with only the lowest possible vote count? Why was there so much bribery, coersion, arm twisting, and ONLY with democraps voting for it? Why was it drafted in the dark of night, with no public input? Had to be voted on Christmas eve, at almost midnight no less? Hell, if it were anything good, it would have sold itself, wouldn't it?
