n 2001 ATF expanded the scope of the firearms subject to the exception provisions of Title 18 U.S.C. §925(d)(3) to cover additional semi-automatic firearms including the FAL type receivers manufactured by IMBEL. The new policy that restricted the commercial sales of those receivers, provided an exception authorizing their importation on limited grounds for repair or replacement of existing firearms only. Pursuant to provisions of Title 27 C.F.R. § 478.112(d)(1), within 15 days of release from U.S. Customs, the serial number(s) of imported firearms must be reported to ATF. Therefore, ATF can readily identify the receivers that are subject to that restriction. This IMBEL receiver was imported in 2001 pursuant to an import permit that had been approved prior to implementation of that policy and did not contain any restrictions for lawful commercial sales.
