Pa Commonwealth court threw out a suit by members of the Phila. Council to allow them to ban handgun and AW sales in the city. Commonwealth court has said that since those are not addresed in the Constitution or codes, they do not apply and Phila. cannot make thier own rules/laws exceeding or suerceeding the State's
More to come; but it looks like Philly got some comeuppance :D

Unfortunately, like New York City and New York State next door, Philadelphia will probably just continue in violation of State law...

Not that I'm trying to downplay the importance, at some level, of the Pennsylvania Commonwealth Court's decision, of course...

"Commonwealth Court dismissed a lawsuit against the Legislature filed by two members of Philadelphia's City Council, Darrell L. Clarke and Donna Reed Miller ... George Bochetto, a lawyer for Clarke and Miller, said he expected to appeal. Bochetto said he was encouraged that the city would prevail because the Commonwealth Court decision relied on the 1996 case, rather than on the court's own reasoning."
